Terms of Service

01

About these terms

These Terms of Service ("Terms") apply to the purchase of the Footwear Design & Development service ("Service") offered by MURCIELACO LLC, operating as MURCIELACO STUDIOS ("MURCIELACO", "we", "us"), on services.murcielaco.com and through our payment links.

By checking the terms box at checkout and completing payment, you ("Client") confirm that you have read, understood and accepted these Terms and the MURCIELACO Design Workflow & Project Terms (Annex A).

02

What the Service includes

Unless the Project Agreement states otherwise, the Service covers one (1) footwear model and includes:

  • One footwear design developed for 3D printing, either created from scratch or developed from a design in our catalog and adapted to your brand.
  • Creative direction within the approved project scope.
  • 3D footwear modeling and print‑ready CAD files prepared for the agreed platform (Zellerfeld by default).
  • Integration of the logo or brand assets you provide into the design.
  • Preparation and submission of the design to Zellerfeld, and reasonable technical adjustments requested during its review.
  • Ten (10) photorealistic 3D renders of the final approved design.
  • Up to two (2) rounds of consolidated revisions within the approved design direction.

The Service does not include brand identity or logo design, website design, marketing campaigns, physical samples, manufacturing, shipping, legal or trademark clearance, or extra renders, animations or design variations. These can be quoted separately.

03

Monthly slots and non‑refundable payment

MURCIELACO accepts a limited number of projects per month. Your payment confirms the reservation of one of those slots. Once reserved, we decline other work for that period, and the slot cannot be reassigned to another client.

For this reason, all payments are non‑refundable, including when the Client cancels, changes their mind, does not sign the Project Agreement, does not provide the required materials, or stops responding.

The only exception is a material failure by MURCIELACO to provide the Service described in these Terms. In that case we will first offer to correct the issue, and if we cannot, we will refund the portion of the fee that corresponds to the work not delivered.

Individual creator pricing. Promotional prices published on services.murcielaco.com (for example the October 40% discount) are offered to individuals. Projects for companies and brands are quoted at the standard rate of USD 9,990 per model unless agreed otherwise in writing.

Payment is due in full, in USD, before work begins. If you pay with Klarna, Klarna pays MURCIELACO the full amount and your installment plan is a separate agreement between you and Klarna. Cancelling the Service does not cancel your obligations to Klarna.

04

Moving your slot

You may reschedule your reserved slot once, to any month within the following three (3) months, by writing to contact@murcielaco.com at least seven (7) days before your project start date. The new start date depends on studio availability. A second reschedule, or a request made with less notice, is at MURCIELACO's discretion.

05

Project Agreement

After purchase, we send you a Project Agreement based on our 3D‑Printed Footwear Design Agreement. It records the specifics of your project: the chosen model or brief, your brand assets, the final decision‑maker, timeline and any particular requests.

  • The Project Agreement adds project‑specific details. It does not reduce the Service or change these Terms against you unless both parties agree in writing.
  • Requests outside the standard Service (for example exclusivity, extra models, extra renders or a different platform) may be quoted as additional fees in the Project Agreement.
  • If the Project Agreement is not signed within fourteen (14) days of purchase, MURCIELACO may proceed with the standard Service under these Terms and Annex A.
  • Where the signed Project Agreement and these Terms conflict on a project‑specific point, the Project Agreement prevails for that point only.
06

Timeline

The project timeline starts once the Project Agreement is signed (or the standard Service begins under clause 05), full payment has been received, and you have provided the required references, brand materials and the name of the final decision‑maker.

Turning an approved concept into print‑ready files usually takes about two weeks. Most projects reach submission within about one month, but timelines are estimates. Late or unclear feedback, changes of direction and third‑party review times can extend them.

07

Feedback, revisions and changes of direction

Please send consolidated written feedback within three (3) business days of each delivery. A revision round is one consolidated set of written feedback within the approved direction.

Changing the footwear category, last, platform, target user, intended use, construction system or overall design language after approval is a change of direction, not a revision. It may require a new scope, timeline and fee, as described in Annex A.

08

Zellerfeld and third‑party platforms

Zellerfeld is an independent platform. MURCIELACO prepares and submits the design and makes reasonable technical adjustments requested during review, but final approval, production, pricing, printing and sales are decided by Zellerfeld and are outside our control. We do not guarantee platform approval, commercial success or sales.

If a technical issue is caused by our own design error within the approved scope, we will correct it at no extra cost.

09

Ownership and commercial rights

After full payment, the Client receives commercial rights to the specific final approved footwear model, including the right to produce and sell it under the Client's brand through Zellerfeld or another agreed platform.

MURCIELACO keeps ownership of its internal source files, methods, parametric systems, reusable geometry, know‑how, and any unused or rejected concepts. Exclusivity over a design, territory or category is not included unless agreed in writing in the Project Agreement.

The Client confirms that it has the right to use any logos, trademarks or materials it provides. MURCIELACO may show the final design in its portfolio once the project is public, unless confidentiality is agreed in writing before work begins.

10

Clients in the EU and UK

If you are a consumer in the European Union or the United Kingdom, by completing payment you expressly request that MURCIELACO begin the Service immediately and acknowledge that you lose your right of withdrawal once the Service has been fully performed. If you exercise a statutory right of withdrawal before then, you agree to pay for the work and the reserved slot provided up to that point, to the extent permitted by law.

11

Liability

To the extent permitted by law, MURCIELACO's total liability for any claim related to the Service is limited to the fees actually paid for that project. MURCIELACO is not responsible for delays or issues caused by third‑party platforms, manufacturers, incorrect information provided by the Client, or the Client's commercial decisions.

12

Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States. The parties will first try to resolve any dispute in good faith in writing, and may then agree to mediation before any other proceeding. These Terms are written in English, and the English version prevails over any translation.

13

Annex A: MURCIELACO Design Workflow & Project Terms

Annex A forms part of these Terms and describes in detail how we manage project foundations, the final decision‑maker, concept and development phases, the base 3D model, feedback windows, revisions, changes of direction, technical limitations, pauses, production, termination and project completion. A copy is sent with your Project Agreement and is available on request at contact@murcielaco.com.

If these Terms and Annex A conflict, these Terms prevail.
